          Terms & Conditions

          For the following definition of this document Products “goods” will be defined as materials that are subject to the Building Act 2004 and implied warranties. No goods will be subject to the Consumers Guarantee Act (CGA) as they fall outside of the product or services definitions.

          All our goods are plumbing products or support plumbing products in association with the AS/NZS 1546.2:2008 On-site domestic wastewater treatment units – Waterless composting toilets standards

           

          1. TRADING INFORMATION

          Waterless Composting Toilets NZ Limited is a New Zealand owned business. Invoices and statements relating to purchases and shipping via our Shopping Cart will be issued to you by Waterless Composting Toilets NZ Limited at the email address you supplied during registration to our website.  The name that will appear on your invoices and statements will be Waterless Composting Toilets NZ Limited.

          2. MINIMUM AGE AND LEGAL CAPACITY

          Purchasing products or services is restricted to individuals 18 years of age or older. Individuals below the age of 18 may have purchases made on their behalf by a parent or guardian.

          Should we suffer any loss or damage as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.

          3. ACCURACY OF PRODUCT DESCRIPTION

          All products (goods) and services listed on this website are described to the best of our abilities and use the information available to us at the time. Care is taken to ensure that this information is correct, but we cannot eliminate the possibility of:

          • Human error in the entry of information
          • Incorrect information provided to us by suppliers or distributors
          • Failure of suppliers or distributors to supply updated information to us

          We reserve the right to change any information including but not limited to pricing, specifications, descriptions, or product names without notice.

          4. PAYMENT

          All orders are placed in New Zealand dollars.

          All orders must be pre-paid before fulfilment. 

          If an order is not paid within 2 weeks, it will be cancelled.

          In the case that you pay for an order with your credit card, we do not store your credit card number on our servers, however, it may be retained by our payment gateway provider in circumstances where this is required.

          In the case of offline payment, we will contact you to arrange payment. This process must be completed before your order can ship.

          In cases where your payment for an order fails for reasons including but not limited to insufficient card credit, or cheque dishonour, we do not warrant that stock will be held until an alternate payment method is available or the original payment method is made to function.

          Our payment service provider is Windcave where the transitions are secured with Visa AIS and MasterCard SDP (PCI DSS) and sensitive information is encrypted with the 3DES protocol. 

          5. PRICES AND TAXES

          Pricing – All prices are Recommended Retail Pricing (RRP)

          Taxes – G.S.T. is Government Goods & Services Tax applied to prices at the rate of 15%

          Display – All prices are displayed excluding G.S.T. if applicable to the product and in New Zealand Dollars.

          If we determine that you are in a foreign country, we may display prices to you without GST and/or in alternate currencies.

          6. SHIPPING AND FREIGHT

          Our delivery time frames range from one week to four weeks depending on stock transitions.  Notice of when your goods are dispatched will be provided to you at your registered email address.

          Clause 1. We cannot take responsibility for how long the goods are in transit or if there are any events that may interfere with or slow down the delivery time.

          Clause 2. If the stock is not available in the Australasian area, goods will have a restock wait time of one to three months. Notice will be given, and alternative options presented if the wait time is undesired. 

          Clause 3. Changing the delivery address post-order incurs additional fees if the new shipping costs exceed the original shipping costs. Fees are $15 or the entirety of the shipping balance, whichever's greater.

          Clause 4. All shipping costs provided on the website are estimates only. The surcharge will be charged to the customer if real shipping costs exceed $15 or 5% of the shipping estimate.

          Clause 5. If delivery of goods is impeded due to a lack of communication or the inability to physically deliver goods to the customer's specified premises, the freight company will initiate a return of goods to WCTNZ®. Any back-charges incurred by WCTNZ® for the return of the goods and re-delivery costs will be the client's responsibility.

          7. PICK UP ORDERS

          Pick-up orders are limited to 2 week hold time. In the second week, a contact attempt will be made. Cancellation will occur within 1 month of ordering. Cancellation fees will apply.

          8. UNCLAIMED GOODS

          In the event that goods remain unclaimed by the customer for a period of three (3) months from the date of dispatch, due to the customer's failure to pick up or receive the goods, WCTNZ® reserves the right to assume ownership of said goods. Concurrently, the associated order will be considered cancelled with no possible remuneration.

          9. RETURN POLICY

          Note: All return requests are to be performed by the original purchaser with the original order number via the MY ACCOUNT menu by viewing the order and using the return request tab.

          WCTNZ® will only accept goods returned with prior notification.

          Refunds are only applicable to products that have not been used. Once used, products are eligible for Buy Back only.

          Terms of refund

          If a product is purchased that satisfies one or more of the following cases, we will arrange a refund or replacement of the affected part:

          Terms: “goods” & "products" are defined as the material property, NOT the shipping and/or handling charges or any other services associated with the goods.

          Dispatched Goods

          1. The component is proven to be faulty within the warranty period
          2. The product does not match its description as provided when sold
          3. The product received is not the product ordered
          4. The product or component has proven to have been damaged in transit (see note 1).
          5. Unused products may be returned upon request (restock and admin fees will apply).
          6. The return is at the buyer’s risk and cost during the 30 days cooling-off period (plus 5 days for delivery) for a total of 35 days from the shipped date

          Refundable Sums

          1. The refund sum is from the GST-inclusive sum of the goods less a 25% restocking fee if the product is returned in the original condition and packaging
          2. If the product is in less than original condition Waterless Composting Toilets NZ reserves the right to recoup the cost of repairs & repacking from the refund sum up to 75% of the GST inclusive sum
          3. All fees will be deducted from the sum of the refund

          Non-Dispatched Goods Caveats 

          1. Goods that have not been dispatched will incur a 15% cancellation fee if canceled. This covers transaction fees and administration costs
          2. The minimum charge on all refunds will be 10 dollars admin fee plus the cost of transactional fees
          3. All fees will be deducted from the sum of the refund

          Notes; On the receipt of goods by the buyer

          1. Products that are damaged in transit should not be signed for at the point of delivery as this will incur a change of ownership to the receiver and the delivery company & Waterless Composting Toilets NZ Ltd cannot accept liability of the condition of the goods after a signed receipt of goods

          Notes; On the return of goods to the seller

          1. Products returned without prior notice will be rejected and shipped back at the buyer's cost or otherwise negotiated by the seller
          2. Please ensure that returned products are safely packed in their original packaging. We will not be held liable for damage to products incurred during the return delivery
          3. Buyer must send returned goods with signature required status and the following details “Attention; WCTNZ Return’s” followed by the order/invoice number
          4. Return request approval requires the recite of the goods and inspection
          5. When a return request has been approved by Waterless Composting Toilets NZ the refund will be transferred on the 20th of the following month or 10 days after the approval date

          Refunds will be issued to the extent required by the Fair Trading Act 1986 (FTA) and Building Act 2004 (BA). No part of these terms of use is to be taken as an express or implied repudiation of our obligations under these pieces of legislation.

          10. ORDER SWAPS

          If you need to change your order, order swaps can be performed on non-dispatched orders only, within 21 days of the original order date. Please get in touch via email: sales@wctnz.co.nz. Order swaps will incur a $100 administration fee.

          11. WARRANTIES

          Waterless Composting Toilets NZ is to furnish new parts to a customer whose toilet fails within the allotted warranty period for the components (parts), provided that our inspection shows that such failure is due to defective material or workmanship. Any part supplied is warranted for the balance of the original warranty period based on the respective manufacturer’s warranty (listed below).

          All support information for warranty claims is to be supplied by the customer to WCTNZ® within 21 days of alerting WCTNZ® to the fault. This may include SO and SN numbers, order number, photographs of the faults and any other relevant information WCTNZ® requests.

          The warranty period for a part begins from the date the original product was dispatched (plus 5 day additional days for transportation).

          All faulty parts are to be returned to WCTNZ®, shipping of these is the customer's responsibility.

          If a warranty replacement part is sent out and the original part is proven to not be faulty, the customer will be charged for the replacement part.

          •          Any fibreglass component - 3 year
          •          Toilet seats - 1 year
          •          Any other component - 1 year

          Nature Loo™ | Warranty Period: 10 Years Limited Warranty

          •          Any electrical component including solar - 1 year
          •          Any rotomolded component- 10 years
          •          Any fibreglass component - 3 year
          •          Toilet seats - 1 year
          •          Any other component - 1 year

          Sun-Mar™ | Warranty Period: 5 Years Limited Warranty

          •          Fiberglass component - 5 years
          •          Any rotomolded component- 5 years
          •          Any other component - 3 years

          Ecolet™ | Warranty Period: 3 Years Limited Warranty

          •          ABS plastic – 3 Years
          •          Any other component – 1 Year

          Excludes general wear & tear.

          Bambooloo™ | Warranty Period: 2 Years Limited Warranty

          •          Structural - 2 year
          •          Toilet seats and components - 1 year
          •          Any other component - 1 year

          Follow the Bambooloo maintenance guide and treat your Bambooloo system like you would a beautiful piece of furniture.

          Excludes general wear & tear.

          These warranties do not cover:

          • Damage resulting from neglect, abuse, accident, alteration; or damage caused by fire, flood, acts of god, or other causality.
          • Damage resulting from the failure of the purchaser to follow normal installation and operating procedures outlined in the manual or in any other printed instructions supplied with the system.
          • Labour and service charges incurred in the removal and replacement of any parts found defective under this warranty.
          • Shipping costs of returned and/or replaced items.

          Defective Goods warranties are limited to, at WCTNZ’s® option: 

          1. replacing, at WCTNZ’s® premises, the relevant Goods; or
          2. refunding the sale price of the relevant Goods; or
          3. repairing the Goods

          No claim based on defective Goods will be allowed unless: 

          1. The claim is notified to WCTNZ® within seven days of delivery to the buyer; and
          2. WCTNZ® is given a reasonable opportunity to investigate the claim.

          12. BUY BACKS

          Buy Backs are performed at 20-40% of the original purchase ticket value (depending on condition, at the discretion of WCTNZ®) and are limited to systems under 3 years old. Buy Backs must be arranged with WCTNZ® first - products shipped to WCTNZ® without prior notice will not be accepted.

          13. TAX INVOICE AND CUSTOMER STATEMENTS

          Upon completion of your order, we will supply a Tax Invoice to you in the form of an email. Please ensure that the email address you have provided us is correct.

          14. SECURITY

          We use industry-standard SSL encryption where applicable to protect the privacy of information in transit between this website, yourself, and our suppliers including payment gateways.

          You acknowledge that the security of communications sent by electronic means cannot be guaranteed. You provide information to us via the internet at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not wholly within our control.

          15. LIMITATION OF LIABILITY

          Under no circumstances will we be liable for any direct, indirect, incidental, consequential, or other damages resulting from the purchase, delivery, use, or return of any product or service purchased from this website beyond the value of the item purchased, including but not limited to loss of profits or interruption to business.

           

          General Terms

          1. JURISDICTION

          These terms shall be construed in accordance with and governed by the laws of New Zealand. You consent to the exclusive jurisdiction of the courts in New Zealand to determine any matter or dispute which arises under these terms.

          2. ACCESS

          While we make every reasonable effort to ensure that the website is always available and fully operational, we do not make any representation or warranty that your access will be uninterrupted or error-free. Your access to this website may be suspended without notice in the case of system failure, maintenance or repair or any reason beyond our control.

          We reserve the right to change or discontinue any feature or service on the site at any time without notice.

          We reserve the right to terminate your access to this website and prevent further access without warning or notice in response to breaches of this policy by yourself, breaches of any applicable laws, or suspicious activity.

          3. CONDUCT

          You must not use, or attempt to use this website:

          • in breach of any applicable laws of the Commonwealth of New Zealand, or local laws in your jurisdiction
          • to impersonate any person or entity
          • to solicit money, passwords, personal information, or other property from any person or entity
          • to harm, abuse, harass, threaten, stalk, intimidate or offend any person or entity
          • to publish or facilitate the publication of personal information of a third party without their consent
          • to publish or facilitate the publication of material for which you do not have ownership, title, or consent from the owner or title holder to do so
          • to publish or facilitate the publication of pornographic or offensive material
          • to publish or facilitate the publication of material including viruses or other computer code, files, or programs designed to interrupt or damage the functionality of computer software or hardware
          • to publish or facilitate the publication of advertising material for yourself or any other party without our express consent to do so

          Breaching these rules of conduct may result in the termination of your access to this website and the prevention of further access without warning or notice.

          4. PRIVACY

          Please review our Privacy Policy (link), which also governs your visit to this website, to understand our practices.

          Australian enquiries: As Ecoflo's New Zealand Distributing Agency, we will forward any enquiries coming from Australia to Ecoflo to be disseminated amongst the local Australian dealers network.  The use of your information will be subject to the Ecoflo's Terms and Conditions under Australian law.

          Except where expressly provided to the contrary by these terms, you do not have any right, title, or interest in or to any proprietary rights relating to the website.

          This website may contain material that is protected by copyright, trademark, and other laws. Except where expressly provided to the contrary, you may only reproduce and distribute the material on the website for your own personal, non-commercial use. Material published on or sourced from this website must not be used, stored, reproduced, published, altered or transmitted in any form or by any means in whole or in part without our prior written consent, with the following exceptions:

          • Where such use, reproduction, etc, constitutes Fair Use under the Copyright Act
          • Where such use, reproduction, etc, is undertaken by normal processes on your computer only (such as your web browser's cache).
